Appendix K Flexibility Update!

As a reminder, the pandemic-related flexibility that allows reimbursement to spouses, or parents of children under age 18 for providing personal care services to waiver eligible consumers will end on February 29, 2024. For more information, please visit: https://dmas.virginia.gov/for-providers/long-term-care/waivers/legally-responsible-individuals/.

NOTE: If you are not a parent/step-parent/legal guardian of a consumer that is a minor nor a spouse of the consumer, this change does not apply to you. No action is needed.

VA Pay Rate Increase!

Effective January 1, 2024, the attendant hourly pay rate will increase five percent for the
Consumer Direction Program. The new rate will be reflected on the 12/21/23 – 1/3/24
payroll for Schedule A and the 12/28/23 – 1/10/24 payroll for Schedule B and forward.
No action is required.

A Message from the Department of Medical Assistance Services (DMAS)

The pandemic-related flexibility that allows parents of children under age 18 and spouses to be reimbursed for providing personal care services will end on November 10, 2023. To ensure a smooth transition, Employers of Record should search for an alternate caregiver as soon as possible.

Your services facilitator should be able to assist in locating resources to find qualified attendants and steps in the hiring process. The Consumer Directed Services Employer of Record Manual provides helpful information on hiring attendants. The EOR manual can be found on the DMAS website at: https://dmas.virginia.gov/for-providers/long-term-care/waivers/.

DMAS is awaiting Federal approval to permanently allow parents of minors and spouses to be paid to provide personal care services when no one else is available. EORs will have to show their recent efforts to hire an attendant, and no one else is available. DMAS will provide training for families and providers once Federal approval is received.

SPECIAL NEWS: One-Time COVID-19 Supplemental Support Payment Information

The Department of Medical Assistance Services (DMAS) will provide Consumer-Directed (CD) Attendants who worked anytime between July 1, 2021 and September 30, 2021 with a Covid-19 supplemental support payment of $1,000. This one-time, pre-tax payment is subject to all applicable taxes and withholdings, including garnishments. 

In order to be eligible for the supplemental payment, the attendant must have:

  • Worked during this time period; and
  • Turned in the time worked and received payment

To qualify for the one-time payment, eligible attendant work hours must be submitted, approved and paid no later than December 31, 2021.  Time submitted after the deadline will not qualify the attendant for the supplemental payment, even if they worked during the eligible timeframe.

A Virginia Medicaid bulletin regarding the one-time supplemental support payment was issued November 1, 2021.  DMAS anticipates payments will be made no later than March 2022.  Eligible attendants will receive their payment from one of three Fiscal/ Employment Agents: Consumer Direct Care Network, Public Partnerships, LLC, or ACES$ Financial Management Service.
